These Terms & Conditions apply to your use of the Reading with Monty app, website and associated resources.

Reading with Monty is owned and operated by Heligotech Pty Ltd (ABN 63 686 085 978), trading as Reading with Monty (“Reading with Monty”, “we”, “us” or “our”).

By using Reading with Monty, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, you should not use the service.

1. About Reading with Monty

Reading with Monty is an educational reading and spelling app designed primarily for children who are struggling with foundational reading and spelling skills.

Reading with Monty provides educational activities and support. It does not guarantee a particular educational outcome or rate of progress. Children differ in their learning needs and responses to instruction.

Nothing in these Terms excludes any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

2. Parent or guardian involvement

Reading with Monty is designed for children to use with the involvement of a parent, guardian or other responsible adult.

If you permit a child to use Reading with Monty or provide information about a child, you confirm that you are the child's parent or guardian or otherwise have authority to do so.

3. Devices and use of the app

Reading with Monty requires two compatible devices for normal use: one used by the child and one used by the parent or instructor. These may be compatible Apple or Android phones or tablets.

The app records learning progress so that activities and levels can respond to the learner's previous use. A subscription is therefore designed to be used with one child's learning profile at a time.

Although another child may technically be able to use the app, sharing the same learning profile between children may affect progress records, unlocked levels, timing information and the way activities operate. For this reason, Reading with Monty does not recommend sharing one learning profile between multiple children.

4. Subscriptions and free trials

Reading with Monty is currently offered as an automatically renewing monthly subscription.

The current Australian subscription price is displayed in the Apple App Store or Google Play at the time of purchase. Where an eligible introductory free trial is offered, the length and conditions of that trial will also be displayed by the relevant app store before you subscribe.

Unless cancelled before the end of an applicable free-trial or subscription period, the subscription will automatically renew and the payment method associated with your Apple App Store or Google Play account will be charged in accordance with the terms displayed by that platform.

Eligibility for introductory offers and free trials is determined by the relevant app store and may not be available to users who have previously used an introductory offer.

Subscriptions and cancellations are managed through the Apple App Store or Google Play account through which the subscription was purchased.

Cancelling prevents future renewal but does not ordinarily end access immediately. Access generally continues until the end of the applicable subscription or trial period, subject to the rules of the relevant app store.

5. Prices, refunds and consumer rights

Prices displayed through Apple or Google may vary by country, currency, taxes and app-store pricing arrangements.

Payments and app-store refunds are processed through the platform through which the subscription was purchased and may also be subject to that platform's terms and policies.

Nothing in these Terms limits or excludes any guarantee, right or remedy available to you under the Australian Consumer Law that cannot legally be limited or excluded.

6. Educational content

Reading with Monty is intended as an educational resource. It is not a diagnostic, medical, psychological or therapeutic service and should not be treated as a substitute for individual professional advice where such advice is required.

We do not guarantee that Reading with Monty will be appropriate for every child or that every child will achieve a particular result from using it.

7. Intellectual property

Unless otherwise stated, the Reading with Monty app, website and associated content — including text, graphics, learning materials, activities, designs, audio, visual systems and other original material — are owned by or licensed to Heligotech Pty Ltd and are protected by applicable intellectual-property laws.

You may use Reading with Monty and its resources for your personal, non-commercial use in accordance with these Terms.

You must not reproduce, distribute, sell, modify, publish, commercially exploit or create derivative works from Reading with Monty content except where permitted by law or with our prior written permission.

8. Acceptable use

You must not:

use Reading with Monty for an unlawful purpose;
attempt to gain unauthorised access to the app, systems or data;
interfere with the operation or security of the service;
copy, reverse engineer or commercially exploit the app except to the extent expressly permitted by law; or
use Reading with Monty in a way that infringes the rights of another person.

9. Availability and changes

We may update Reading with Monty from time to time to improve functionality, correct errors, maintain compatibility, address security issues or modify educational content.

We may need to temporarily suspend access for maintenance, technical problems or circumstances beyond our reasonable control.

We do not guarantee uninterrupted or error-free availability of the app or website.

Where a change materially affects a paid service, we will comply with applicable consumer law.

10. Third-party platforms and services

Reading with Monty relies on third-party platforms and services, including Apple and Google for app distribution and subscription processing.

Your use of those platforms may also be subject to their own terms and conditions.

11. Privacy

Personal information is handled in accordance with our Privacy Policy.

A parent, guardian or other authorised adult should review the Privacy Policy before allowing a child to use Reading with Monty.

12. Ending your use of Reading with Monty

You may stop using Reading with Monty at any time. Cancelling a paid subscription must be done through the Apple App Store or Google Play account through which it was purchased.

We may restrict or terminate access where reasonably necessary because of serious misuse, unlawful conduct, security concerns or a material breach of these Terms, subject to applicable law.

13. Liability and Australian Consumer Law

Reading with Monty comes with rights and guarantees that may apply under the Australian Consumer Law and which cannot be excluded by these Terms.

Nothing in these Terms is intended to exclude, restrict or modify any right, guarantee, condition, warranty or remedy where doing so would be unlawful.

To the extent permitted by law, Reading with Monty is not responsible for loss caused by matters outside our reasonable control or by use of the service contrary to these Terms.

15. Changes to these Terms

We may update these Terms from time to time. The current version and effective date will be published on our website.

Where a change materially affects an existing paid subscription, we will comply with applicable consumer-law requirements.
