1. Acknowledgment and acceptance of General Conditions
•Reading with Monty is governed by our terms, conditions referred to on this page (General Conditions). The Site refers to all access to Reading with Monty, via our website www.readingwithmonty.com or our mobile app.The Sites are owned and operated by Heligotech Pty. Ltd. (63 686 085 978) trading as Reading with Monty.
•Your access to and use of the Site (your Access) is conditional on your acceptance and compliance with these General Conditions.
•Your Access to the Site constitutes the legal agreement entered between you and Heligotech Pty Ltd (Reading with Monty), concerning your Access and you agree to be bound by these General Conditions. If you do not agree with any of these General Conditions, you must cease using the Reading with Monty app and www.readingwithmonty.com.
•These General Conditions apply to all users, regardless of whether a licence to Access is purchased or arranged by (a) a school or educational institution on behalf of students and teachers, or (b) a parent, guardian or student over 18 years of age, for their students and users. In the case of student users who are minors, permission must be given by the student’s school, parent or guardian (as applicable) before that student is provided with Access to the Site.
•By entering student information to our Site, you represent that you have the authority (including from the parent or guardian, if required) to consent to our processing and use of the student’s first name in accordance with our Privacy Policy.
•We reserve the right, at our discretion, to revise, amend and update the General Conditions. When we make changes to these General Conditions, we will notify you by posting a revised version of the General Conditions on this website with the effective date. By continuing to access the Site on or after the effective date of change, you agree to abide by the terms of the General Conditions as amended. If you do not agree to the amended General Conditions, you must not continue to use the Site.
2. Privacy
•Privacy Policy: Your access to and use of the Site is subject to our Privacy Policy, which forms part of these General Conditions. You should review our Privacy Policy before using the Site. All personal information (including Personally Identifiable Information, or PII) collected as a result of your access will be handled in accordance with our Privacy Policy.
•Children’s Information: When you provide PII for a child or student, you represent that you have obtained the necessary consents (including from a parent or guardian, if required). By allowing a child or student to use the Site, you consent to our collection, storage, and processing of that information in line with our Privacy Policy.
3. Individual Licences (“Home Subscriptions”)
•Licence Agreement: Your access to and use of the Site and associated resources is subject to these General Conditions and our Privacy Policy.
•Non-Commercial Use: Home subscriptions are provided for personal, non-commercial use. Each subscription is assigned to an individual user and student, with access granted to only the nominated user and student.
•Subscription Term & Renewal: Home subscriptions are automatically renewed unless you cancel before the end of the current term. A minimum term of one (1) month applies, and each renewal is for a similar term. You can manage your subscription and cancel it through your account settings. Cancellation will be effective at the end of the current term. Refunds will not be provided unless required by law or under our returns policy, regardless of cancellation during a term.
•Pricing: Subscription fees are displayed at the time of purchase. Fees will be charged to your nominated payment method on a recurring basis until cancellation. The price for each renewal term will be the then-current fee for the selected subscription.
•Promotions and Trials: Promotional pricing, discounts, and free trials apply only for the specified period. After this period, your subscription will revert to the standard pricing unless otherwise specified. Taxes are included in the invoice.
•Delivery of Services: Access to services is provided immediately after payment is processed.
•User Costs: You are responsible for any costs associated with accessing the Site, including internet, data, and hardware costs. You must ensure that your device and internet connection meet the minimum requirements.
•Returns & Refunds: We comply with Australian Consumer Law, which guarantees that goods and services are of acceptable quality and fit for their intended purpose. If goods or services are faulty or not as described, we will either repair, replace, or refund them as required by law.
4. School Subscriptions
•School Customers: For School Customers (schools or educational institutions), a separate agreement governs the purchase of licences for teachers and students (“Purchase Terms”). The use of the Site by School Customers is governed by both these Purchase Terms and these General Conditions.
•Student Data: Any data collected through the Site that is identifiable to a student is considered student data and is controlled by the relevant School Customer.
5. Trial and Subscription Features
•Modification of Trial or Free Features: If your access is to trial or free resources, we may modify or remove such features at our discretion.
•Paid Features: If you have a paid subscription, some features may carry additional charges. You acknowledge that additional fees may apply for certain features.
6. User Code of Conduct
You agree that you and your users will comply with the following:
•Personal Use: Reading with Monty Content is for personal use only. You may not use it for commercial purposes without our written consent.
•Acceptable Use: You will not use the Site or Reading with Monty Content in an unlawful manner or in a way that infringes on our rights or the rights of others.
•Account Security: You are responsible for keeping your login details secure. If you suspect any unauthorised use of your account, you must notify us immediately.
•System Security: You are responsible for ensuring your device is secure and does not expose you to any risks, such as viruses or malicious code. We are not responsible for any damage to your devices or systems from using the Site.Prohibited ConductYou must not:
•Circumvent security systems or use fraudulent means to access the Site;
•Access another user’s account or personal information;•Upload or transmit harmful data (e.g. viruses or corrupted files);
•Modify, distribute, or reverse engineer any part of the Site without our written consent.We may suspend or terminate your access for any breach of these General Conditions, including any conduct deemed inappropriate or unlawful.
7. Ownership of Content
•Reading with Monty Content: All materials on the Site, including software, text, graphics, video, and data, are the intellectual property of Reading with Monty or its licensors and are protected by copyright, trademarks, and other intellectual property laws.
•Use of Content: You may not copy, distribute, or exploit any Reading with Monty Content except as permitted by law or with our written consent.
•Modifications: We may modify, delete, or update any content or features at any time without prior notice.
8. Copyright
•Copyright Ownership: Copyright in the Site and all associated content is owned by Heligotech Pty Ltd, its affiliates, or licensors.
•Restrictions: You may not adapt, reproduce, distribute, or commercialise any part of the Site or its content unless permitted under Australian Copyright Law or these General Conditions.
•Remuneration for Educational Institutions: Where applicable, educational institutions may be required to pay for the use of certain printed or photocopied materials under relevant copyright remuneration schemes.
9. Trademarks
•Trademark Ownership: Any trademark, logo, or device with the ™ or ® symbol is our property, and we assert our rights under Australian and international law.
•Permissible Use: You may only use our trademarks with prior written permission and in a way that accurately attributes ownership to us. You must not use our trademarks in a manner that is misleading, deceptive, or disparaging.
10. Disclaimer and Limitation of Liability
•Use at Your Own Risk: You agree that use of the Site is at your own risk. While we strive for accuracy, we make no warranties regarding the reliability, availability, or accuracy of the Site or its content, except as required by Australian Consumer Law.
•Exclusion of Liability: To the maximum extent permitted by law, Heligotech Pty Ltd and its affiliates, employees, and contractors will not be liable for any loss or damage (direct or indirect), except where liability cannot be excluded by law. This includes loss or damage resulting from your use or inability to use the Site, Reading with Monty Content, or any associated website or service.
•Limited Liability: Our liability, to the extent permitted by law, is limited to re-performing the service or the amount you paid for the access or purchase, whichever is lower.
11. Indemnity
You agree to indemnify and hold harmless Heligotech Pty Ltd, its affiliates, employees, and contractors against all claims, losses, damages, or costs arising from any breach of these General Conditions or misuse of the Site by you or any of your users.
12. Limitation of Liability
To the extent permitted by Australian Consumer Law, Reading with Monty’s liability is limited to the total amount paid by you for the services or goods purchased, or AU $100, whichever is lower.
13. Termination
We may suspend or terminate your access at any time without notice, particularly if we believe you have breached the General Conditions. These General Conditions remain in effect until the end of your subscription term, even after termination.
14. General
•Feedback and Complaints: You can contact us at info@readingwithmonty.com for feedback or complaints.
•Waivers: No waiver of rights or obligations will be valid unless made in writing. Failure to act in a particular instance does not waive our right to act in similar circumstances in the future.
•Severability: If any part of these General Conditions is found to be invalid or unenforceable, the rest will remain in full force.
15. Governing Law
These General Conditions are governed by the laws of Australia, and you agree to submit to the exclusive jurisdiction of its courts. We may also act in other jurisdictions where we believe a breach has occurred.
16. Product Feedback or Complaints
To provide feedback or file complaints, please use the form within the app. If you require a response, we may ask for your contact details.
Notes on Australian Consumer Law (ACL) Compliance:
1.Consumer Guarantees: We’ve aligned our policies with ACL consumer guarantees, which ensure that goods and services are of acceptable quality and fit for their intended purpose. Where required by ACL, we will offer repairs, replacements, or refunds for faulty goods or services.
2.Refunds & Returns: Our returns policy complies with ACL, offering refunds or replacements where services or products do not meet the required standards under the law.
3.Limitation of Liability: We have ensured our liability limitations are in line with ACL requirements, which include exceptions for consumer rights that cannot be waived.
